ROOM FOR TOMORROW, INC.
KIDS HAVE A POINT WEBSITE TERMS OF USE
Last Updated and Effective: November 4, 2026
Please read these Terms of Use carefully (“Terms”). These Terms are provided by Room for Tomorrow, Inc. (“Room for Tomorrow,” “we,” “our,” and “us”) and govern your access to and use of the Kids Have a Point website at https://kidshaveapoint.com (the “Website”), including its content, features, functionality, episode pages, links to third-party podcast platforms, and forms. The Website is associated with the Kids Have a Point podcast (the “Podcast”). References in these Terms to “you” or “your” mean each person accessing or using the Website. If you are a parent or legal guardian, you agree to these Terms for yourself and your household. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Website.
THE WEBSITE AND PODCAST CONTENT ARE PROVIDED FOR GENERAL INFORMATION AND ENTERTAINMENT ONLY AND DO NOT CONSTITUTE PROFESSIONAL, EDUCATIONAL, MEDICAL, PSYCHOLOGICAL, LEGAL, FINANCIAL, OR PARENTING ADVICE. USE PARENTAL DISCRETION. DO NOT RELY ON THE WEBSITE OR PODCAST AS A SUBSTITUTE FOR PROFESSIONAL ADVICE.
We reserve the right, at our discretion, to modify, replace, update, or change these Terms or to change, suspend, or discontinue the Website, the Podcast, or any portion of their content or functionality at any time and for any reason. If we make material changes to these Terms, we will post the revised Terms on the Website with an updated “Last Updated and Effective” date and may provide additional notice through other reasonable means. It is your responsibility to review these Terms periodically. Your continued access to or use of the Website after a material change has been posted constitutes your acceptance of the revised Terms. We may also impose limits on or restrict access to all or part of the Website without notice or liability.
1. Eligibility and Website Use:
a. The Website is designed for parents and families. Children may listen to the Podcast and browse the Website only with a parent or legal guardian’s supervision. Anyone under eighteen (18) may use the Website only with a parent or legal guardian’s involvement. Parents and legal guardians are responsible for supervising household use and agree to these Terms for their household. The Website is not directed to children under thirteen (13), and we do not knowingly authorize independent use by children.
b. No account registration is required to access or use the Website. All forms, including the “Be on the Show” form, are for adults only. No person under eighteen (18) may submit a form or provide personal information through a form; a parent or legal guardian must submit any form on a child’s behalf where permitted. We may reject or remove a submission or restrict access to related functionality at any time and for any reason.
c. Parents and other adult visitors may subscribe to receive updates from Room for Tomorrow through an opt-in updates subscription form that is separate from the “Be on the Show” form. Subscribing to updates does not express interest in Podcast participation, and submitting the “Be on the Show” form does not subscribe you to updates. By providing your email address or otherwise communicating with us electronically, you agree that we may send you communications relating to your inquiry, the Website, legal notices, or other administrative matters. We will send promotional newsletters or marketing communications only where you have opted in as required by applicable law. You may unsubscribe from promotional communications at any time by using the one-click unsubscribe link included in each update or other instructions in the communication. Unsubscribing from promotional communications will not prevent us from sending service-related, security, legal, or other non-promotional communications.
PLEASE NOTE THAT WHEN YOU CONTACT US BY EMAIL, SUCH COMMUNICATION MAY NOT BE SECURE OR CONFIDENTIAL. PLEASE DO NOT SEND SENSITIVE PERSONAL INFORMATION TO US THROUGH EMAIL OR THE WEBSITE UNLESS WE EXPRESSLY REQUEST IT.
2. Podcast Content and Platforms:
a. The Podcast features conversations with children sharing their own views and opinions. Each guest’s views are the guest’s own and do not necessarily reflect the views of Room for Tomorrow. Episodes and other Podcast content are provided for general information and entertainment only, are not professional, educational, or parenting advice, and may not be suitable for every family. We try to keep the Podcast family-appropriate, but parents and guardians are responsible for using discretion and supervising listening and browsing.
b. The Podcast is currently available through Apple Podcasts and Spotify and may later be available through YouTube, YouTube Music, podcast hosting and RSS distribution services, and other similar platforms. Listening to the Podcast through Apple Podcasts, Spotify, YouTube, or any other third-party platform is governed by that platform’s terms, privacy policy, and other applicable rules.
c. Room for Tomorrow does not control and is not responsible for any third-party platform, including its availability, functionality, recommendations, rankings, classifications, advertising, content, privacy practices, or terms. A platform may independently host, cache, analyze, recommend, display, archive, or distribute Podcast content, and third parties may make copies of or redistribute content without our control. The Website does not embed podcast players; it includes links to the Podcast on Apple Podcasts and Spotify and may include links to other third-party websites and services. When you click a link, you leave the Website. You access and use those third-party websites and services at your own risk and are responsible for reviewing their terms and privacy policies. A link does not imply endorsement or create an affiliation with its operator.
d. Privacy and Your Personal Information: The Kids Have a Point Privacy Policy and Privacy & Data Retention Notice are incorporated into these Terms by reference. The Privacy Policy and Privacy & Data Retention Notice describe our practices regarding the collection, use, disclosure, retention, and deletion of personal information relating to the Website, the Podcast, and participation inquiries. By accessing or using the Website, you agree to the applicable terms of those policies. For privacy-related inquiries, deletion requests, takedown requests, or to report a privacy or safety concern involving a child guest, please contact privacy@roomfortomorrow.com or hello@roomfortomorrow.com.
e. Be on the Show: The Website may provide a “Be on the Show” form through which a parent or legal guardian may express interest in having a child appear on the Podcast. The form collects only the adult’s name and email address; please do not include any information about your child. Submitting the form does not create any obligation for Room for Tomorrow to contact, select, record, publish, or otherwise feature anyone. The form is for adults only and should be submitted only by a parent or legal guardian on behalf of a household. All further steps, including any communications about participation and any collection of information about a child, take place outside the Website.Participation in the Podcast occurs only under a separate signed Parent/Guardian Consent and Minor Media Release. Participation is voluntary and unpaid; neither a child nor a parent or legal guardian is entitled to compensation unless separately agreed in writing. Room for Tomorrow may choose guests, questions, episodes, and topics, and may decline, pause, edit, or stop participation at its discretion.
A parent or legal guardian must be involved throughout a child’s participation. Room for Tomorrow may record, edit, publish, distribute, and promote approved content only as permitted by the separate Parent/Guardian Consent and Minor Media Release. A child may skip a question, take a break, ask that something not be used, raise a privacy or safety concern, or stop the recording. Room for Tomorrow will not intentionally authorize a child’s recordings, transcripts, images, or personal information to train general-purpose artificial-intelligence models, or create or authorize a synthetic replica, clone, or materially altered simulation of a child’s voice or likeness, without separate express parent or legal guardian permission.
3. Respect for Guests and Community:
a. You may not harass, threaten, stalk, contact, identify, locate, dox, or attempt to identify any child guest or the guest’s family; seek or publish private information; impersonate another person; or use the Website or Podcast to endanger, exploit, or misuse a child. You also may not re-edit, deepfake, AI-clone, synthesize, remix, distort, or otherwise misuse any episode or any child’s voice, image, likeness, statements, or other content in a way that misrepresents or harms the guest.
b. You may not download, copy, store, redistribute, repost, transmit, publicly perform, or commercially exploit an episode or other Podcast content, except for personal, non-commercial listening and sharing official links. You also may not interfere with the Website, bypass access controls, use automated tools to crawl the Website, introduce malicious code, or otherwise violate applicable law. To report a concern about a child guest or Podcast content, use the contact information in the “Privacy and Your Personal Information” section.
4. Privacy and Safety Concerns; Takedowns:
a. If you have a privacy, safety, identification, misuse, or child-welfare concern involving a Podcast episode, guest, or Website content, please report it promptly to privacy@roomfortomorrow.com or hello@roomfortomorrow.com. Before publication, a parent or legal guardian may withdraw participation as provided in the separate Parent/Guardian Consent and Minor Media Release. After publication, Room for Tomorrow will review a serious privacy or safety concern promptly and make reasonable efforts to remove the affected content from channels under its control when appropriate, including within ten (10) business days where practicable.
b. Room for Tomorrow does not have an obligation to monitor every Website page, episode, submission, or third-party service. We may review, restrict, remove, or decline to publish any content or submission at any time, including after receiving a claim or allegation from a third party or authority, or to protect a child’s privacy, safety, dignity, or well-being.
ROOM FOR TOMORROW DOES NOT CONTROL THIRD-PARTY PLATFORMS OR COPIES OF PODCAST CONTENT. WE CANNOT GUARANTEE THE REMOVAL OF CONTENT THAT HAS BEEN DOWNLOADED, SHARED, REPOSTED, CACHED, SYNDICATED, ARCHIVED, OR OTHERWISE DISTRIBUTED BY THIRD PARTIES, INCLUDING APPLE PODCASTS, SPOTIFY, YOUTUBE, OR OTHER SERVICES.
5. Content; Intellectual Property:
a. As between you and Room for Tomorrow, the Website, Podcast episodes and recordings, transcripts, artwork, graphics, text, logos, and other materials provided through the Website (collectively, “Content”) are owned by Room for Tomorrow, its licensors, or the applicable rights holders. A child guest retains ownership of the child’s independent artwork, writing, designs, inventions, or other original creations, subject to any permission granted in a separate Parent/Guardian Consent and Minor Media Release. You must comply with all copyright, trademark, and other proprietary-rights notices included in or accompanying the Content.
b. Subject to these Terms, Room for Tomorrow grants you a limited, revocable, nonexclusive, nontransferable, non-sublicensable license to access the Website and listen to the Podcast for your personal, non-commercial use, and to share links to official Website pages or official Podcast listings. This license does not permit downloading or redistribution of Podcast content.
c. Except as expressly permitted by these Terms or in writing by the applicable rights holder, you may not sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, create derivative works from, or otherwise exploit the Website, Podcast, Content, or any child’s voice, likeness, statements, or other contribution. All rights not expressly granted are reserved.
d. All marks displayed on the Website, including “Kids Have a Point” and “Room for Tomorrow” (collectively, “Marks”), are trademarks or registered trademarks of Room for Tomorrow or their respective owners. Other trademarks, service marks, graphics, and logos appearing on the Website may be the property of third parties (“Third-Party Marks”). Neither your use of the Website nor these Terms grant you any right, title, or interest in, or any license to reproduce or otherwise use, the Marks or any Third-Party Marks.
6. Feedback and Adult Submissions:
a. The Website may provide adults with the ability to submit feedback, suggestions, questions, inquiries, or other material related to Room for Tomorrow, the Website, or the Podcast (collectively, “User Submissions”). You represent and warrant that you have the legal right to submit any User Submission and that doing so will not violate any law or infringe or violate the rights of any person or entity. You retain ownership of your User Submissions. By submitting feedback or suggestions, you grant Room for Tomorrow a nonexclusive, worldwide, royalty-free license to use, reproduce, display, distribute, modify, and otherwise use that feedback or those suggestions for operating, evaluating, improving, and communicating about the Website, the Podcast, and Room for Tomorrow’s business. Personal information will be handled in accordance with the applicable privacy policies.
b. Room for Tomorrow does not endorse and has no control over User Submissions. We have no obligation to monitor User Submissions, but may review, remove, or decline to publish any User Submission at any time for any reason, including to protect privacy or safety or upon receiving a claim or allegation from a third party or authority. We do not undertake to provide a response to every inquiry or submission.
c. You represent and warrant that any User Submission provided by you: (i) will not infringe any patent, trademark, trade secret, copyright, right of publicity, privacy right, or other right of any person or entity; (ii) is not unlawful, threatening, abusive, harassing, defamatory, deceptive, fraudulent, invasive of another’s privacy, tortious, obscene, offensive, or profane; (iii) does not contain malicious code or other files or programs designed to disrupt, damage, limit, or interfere with software, hardware, telecommunications equipment, or any system or data; (iv) does not impersonate any person or entity; and (v) does not violate applicable law.
7. DMCA Notice: Room for Tomorrow respects the intellectual-property rights of others. If you believe that any material on the Website infringes your copyright, please notify us using the contact information in the “Contact” section below. Room for Tomorrow may remove or disable access to allegedly infringing material and may terminate repeat infringers where appropriate.
8. Termination: Room for Tomorrow may suspend or terminate your access to all or any part of the Website at any time, with or without cause or notice, effective immediately. Upon termination of your right to use the Website or Room for Tomorrow’s termination of the Website, all licenses and other rights granted to you by these Terms will immediately terminate. If you have opted into promotional communications, you may discontinue them at any time by using the applicable unsubscribe mechanism. All provisions of these Terms that by their nature should survive termination will survive termination.
9. Warranties; Disclaimers. TO THE MAXIMUM EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE WEBSITE, THE PODCAST, AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” AND ARE WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED. To the extent permitted by applicable law, if you are eighteen (18) or older, you shall indemnify, defend, and hold harmless Room for Tomorrow, its affiliates, and its and their respective employees, contractors, directors, suppliers, partners, and representatives from and against any and all liabilities, claims, or expenses, including reasonable attorneys’ fees, arising out of or relating to: (a) your use or misuse of, or access to, the Website, Podcast, Content, or User Submissions; (b) your breach of these Terms; (c) your negligence, willful misconduct, or violation of applicable law in connection with the Website or Podcast; or (d) your infringement, violation, or misappropriation of any intellectual-property or other right of any person or entity. Room for Tomorrow reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will assist and cooperate with Room for Tomorrow in asserting any available defenses.

NOTWITHSTANDING THE FOREGOING AND TO THE MAXIMUM EXTENT PERMISSIBLE UNDER APPLICABLE LAW, NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
12. Governing Law; Dispute Resolution. A printed version of these Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. These Terms shall be governed by, construed, and interpreted in accordance with the laws of the State of Delaware, without regard to any choice-of-law principle that would dictate the application of the law of another jurisdiction. Any dispute arising from or relating to these Terms or the Website shall be brought exclusively in the state or federal courts located in Delaware, and each party irrevocably consents to that jurisdiction and venue. The parties agree that disputes will be resolved in court and not by arbitration. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable. The failure of either party to exercise any right provided for herein shall not be deemed a waiver of any further rights hereunder.
